DisasterFree, LLC, doing business as Prosrver (“Prosrver,” “we,” “us,” or “our”), provides process serving, legal document delivery, skip tracing, court filing, eFiling, mailing, investigative support related to service of process, and other litigation-support services.
This Privacy Policy explains how Prosrver collects, receives, uses, stores, processes, discloses, and protects personal information in connection with our website, online order forms, case-management systems, communications, payment systems, and professional services.
Because process serving and litigation-support services necessarily involve information concerning people who may not themselves be Prosrver customers, this Privacy Policy may apply to information concerning clients, attorneys, law firms, vendors, process servers, service recipients, defendants, respondents, witnesses, businesses, household members, and other individuals whose information is provided to or obtained by Prosrver in connection with a lawful assignment.
Depending upon the nature of the assignment or interaction, Prosrver may collect, receive, create, or process information including:
(a) names;
(b) residential addresses;
(c) business addresses;
(d) mailing addresses;
(e) email addresses;
(f) telephone numbers;
(g) company and professional information;
(h) billing and transaction information;
(i) case numbers;
(j) court information;
(k) party names;
(l) hearing dates and deadlines;
(m) legal documents;
(n) service instructions;
(o) photographs;
(p) physical descriptions;
(q) approximate age;
(r) vehicle descriptions;
(s) license-plate information;
(t) workplace information;
(u) publicly available information;
(v) database and skip-trace information;
(w) field observations;
(x) GPS or location information associated with service attempts;
(y) dates and timestamps;
(z) photographs or video associated with service activity;
(aa) process-server notes;
(bb) service-attempt histories;
(cc) proofs of service, affidavits, declarations, and related records;
(dd) communications with clients, recipients, agents, vendors, courts, or other persons;
(ee) website, browser, device, IP-address, and technical information;
(ff) account and login information;
(gg) payment and invoice information; and
(hh) other information reasonably necessary to perform or administer a requested service.
Documents submitted to Prosrver may contain confidential, personal, financial, medical, family, employment, litigation, or other sensitive information.
Prosrver processes such information only as reasonably necessary to perform the requested assignment, maintain appropriate business and legal records, comply with applicable law, resolve disputes, protect legal rights, or fulfill another legitimate business purpose.
Clients should avoid providing information that is unnecessary to the requested assignment and should redact sensitive information when legally permissible and appropriate.
Clients may provide Prosrver with information concerning individuals who are not Prosrver customers.
This may include a recipient’s:
(a) name;
(b) home or business address;
(c) photograph;
(d) physical description;
(e) vehicle information;
(f) workplace;
(g) telephone number;
(h) email address;
(i) known schedule;
(j) household or employment information; and
(k) other information intended to assist with lawful service or litigation-support activity.
Prosrver may use this information to perform the assignment for which it was provided and for related operational, legal, evidentiary, safety, recordkeeping, compliance, and dispute-resolution purposes.
Prosrver may obtain information from:
(a) clients;
(b) attorneys and law firms;
(c) online order forms;
(d) email;
(e) telephone calls;
(f) text messages;
(g) courts and court records;
(h) public records;
(i) commercially available databases;
(j) lawful skip-trace or locate databases;
(k) internet research;
(l) process servers;
(m) independent contractors;
(n) local service providers;
(o) filing providers;
(p) field observations;
(q) postal and courier providers;
(r) payment processors;
(s) ServeManager and other case-management technology;
(t) government agencies;
(u) publicly available sources; and
(v) other lawful sources reasonably related to an assignment.
Prosrver may use information to:
(a) receive, review, and administer assignments;
(b) perform process serving and legal document delivery;
(c) identify or locate service recipients;
(d) conduct lawful skip tracing or address research;
(e) communicate with clients;
(f) communicate with process servers and vendors;
(g) schedule and manage service attempts;
(h) document field activity;
(i) prepare proofs of service, affidavits, declarations, and other service records;
(j) perform mailing;
(k) perform court filing or eFiling;
(l) process payments;
(m) issue invoices;
(n) manage accounts;
(o) provide status notifications;
(p) respond to questions and customer-service requests;
(q) investigate suspected fraud or misuse;
(r) maintain website and system security;
(s) respond to payment disputes and chargebacks;
(t) maintain business, tax, accounting, and operational records;
(u) comply with legal obligations;
(v) respond to subpoenas, court orders, warrants, or other lawful process;
(w) establish, exercise, or defend legal claims;
(x) protect process servers, clients, recipients, Prosrver, or other persons; and
(y) perform other legitimate activities reasonably related to Prosrver’s services.
By submitting an assignment, the client represents that the client has a lawful basis and sufficient authority to provide Prosrver with the documents, addresses, photographs, descriptions, personal information, case information, and other materials necessary to perform the requested service.
Clients may not use Prosrver’s services to obtain or use personal information for unlawful stalking, harassment, intimidation, fraud, unlawful discrimination, or another unlawful purpose.
Prosrver may provide information to independent process servers, process-serving agencies, investigators where legally appropriate, couriers, filing providers, mailing providers, and other contractors or vendors when reasonably necessary to perform an assignment.
Information disclosed to these persons will generally be limited to information reasonably necessary to perform the assigned work.
Prosrver currently uses ServeManager, an InfoTrack platform, for certain case-management, process-serving, communication, documentation, and related functions.
Information entered into, uploaded to, stored within, or transmitted through ServeManager may be processed by InfoTrack and its service providers according to their respective terms, privacy policies, security practices, and applicable law.
ServeManager represents that its platform uses security measures including secure HTTPS connections, encryption, access controls, encrypted storage, backups, and SOC 2 compliance.
Prosrver does not own or control ServeManager’s systems and cannot guarantee their uninterrupted availability, future functionality, absolute security, data retention practices, or freedom from technical or cybersecurity incidents.
Prosrver may use third-party providers for services including:
(a) website hosting;
(b) cloud storage;
(c) case management;
(d) email;
(e) text messaging;
(f) payment processing;
(g) database research;
(h) mapping;
(i) court filing;
(j) eFiling;
(k) accounting;
(l) mailing;
(m) courier services;
(n) analytics; and
(o) other operational functions.
Such providers may receive information reasonably necessary to perform their respective services.
Payments may be processed through third-party payment processors.
Where payment information is processed directly by a third-party provider, Prosrver may not receive or store complete payment-card information.
Prosrver may retain transaction information including payment status, amounts, dates, invoice numbers, payment method categories, and related records necessary for accounting, customer service, fraud prevention, chargebacks, and legal compliance.
Prosrver may provide or disclose information to courts, clerks, law-enforcement agencies, government agencies, regulators, or other authorities when reasonably necessary to perform an assignment or when required or permitted by law.
Prosrver may preserve, use, or disclose information when reasonably necessary to:
(a) comply with applicable law;
(b) respond to a subpoena, court order, warrant, or other lawful process;
(c) cooperate with an appropriate governmental or regulatory inquiry;
(d) investigate suspected fraud or unlawful conduct;
(e) protect Prosrver’s legal rights;
(f) enforce Prosrver’s Terms of Use;
(g) protect the safety of a process server, client, recipient, employee, contractor, or another person;
(h) respond to a dispute, claim, or chargeback; or
(i) establish, exercise, or defend a legal claim.
Prosrver does not sell legal case files, service-recipient information, submitted legal documents, service-attempt information, photographs, field observations, or skip-trace results for unrelated advertising purposes.
Prosrver does not use information obtained about a defendant, respondent, witness, recipient, or other service subject to create unrelated advertising profiles about that person.
The Prosrver website may use cookies, analytics tools, logs, and similar technologies to:
(a) operate website functionality;
(b) understand website traffic;
(c) detect security issues;
(d) maintain website performance;
(e) understand how visitors use the website; and
(f) improve website functionality.
Depending upon the technology used, third-party providers may receive device, browser, IP-address, usage, or similar technical information.
Prosrver does not knowingly use confidential legal documents, case information, skip-trace information, or service-recipient information for cross-context behavioral advertising.
If Prosrver’s practices change in a manner that creates additional disclosure or opt-out obligations under applicable privacy law, Prosrver will provide the notices or mechanisms required by applicable law.
Where applicable law requires Prosrver to recognize a legally valid browser-based privacy or opt-out preference signal, Prosrver will honor such signals to the extent required by applicable law and technically applicable to Prosrver’s website practices.
Prosrver uses reasonable administrative, technical, physical, and organizational safeguards appropriate to the nature of its business and the information being processed.
Prosrver may rely on third-party technology and infrastructure providers that maintain their own security measures.
No website, database, cloud platform, electronic transmission, mobile device, computer system, software platform, or information-storage system can be guaranteed to be completely secure.
Accordingly, Prosrver does not guarantee that unauthorized access, cyberattack, data loss, software failure, device failure, or another security event can never occur.
Where lawful, appropriate, safe, and technologically available, service attempts may generate information including:
(a) dates;
(b) timestamps;
(c) GPS or location information;
(d) photographs;
(e) video;
(f) field notes;
(g) property observations;
(h) vehicle observations;
(i) physical descriptions; and
(j) other documentation associated with service activity.
Availability and accuracy of these records may depend upon cellular service, internet access, GPS signal, device functionality, software performance, battery availability, user permissions, safety considerations, privacy restrictions, applicable law, and circumstances encountered in the field.
Prosrver does not guarantee that GPS, photographs, video, or any particular type of electronic field documentation will be available for every service attempt.
Prosrver does not knowingly record confidential communications in violation of applicable law.
Telephone or field communications may be recorded only when legally permitted and after any notice or consent required by applicable law.
Process servers and other representatives may create written notes documenting conversations, statements, observations, and service-related activity.
Prosrver may communicate with clients through:
(a) email;
(b) telephone;
(c) SMS or text message;
(d) ServeManager;
(e) online portals; and
(f) other electronic systems.
Communications may include invoices, payment information, service-attempt notifications, requests for additional information, scheduling information, completion notices, affidavits, proofs of service, and other transactional communications.
Where Prosrver sends marketing communications, such communications will be handled in accordance with applicable law.
Marketing emails will include an appropriate opt-out mechanism where required.
Marketing text messages, if used, will be sent only with any consent required by applicable law.
Transactional messages regarding an active or previous assignment are not necessarily marketing communications.
Prosrver may retain information for as long as reasonably necessary for:
(a) performing requested services;
(b) responding to client questions;
(c) preparing or maintaining proofs of service;
(d) business operations;
(e) accounting;
(f) tax obligations;
(g) litigation;
(h) chargeback disputes;
(i) fraud prevention;
(j) security;
(k) legal compliance;
(l) establishment or defense of legal claims; and
(m) legitimate business recordkeeping.
Retention periods may vary depending upon the type of information and the circumstances of the assignment.
Third-party providers, including ServeManager or other vendors, may maintain information according to their own retention policies.
Clients are responsible for maintaining their own permanent case files and should not rely upon Prosrver as permanent document storage.
Where a person has a legally applicable right to request deletion, Prosrver may nevertheless retain information when permitted or required by law, including where retention is reasonably necessary to:
(a) complete a requested service;
(b) maintain evidence of service or attempted service;
(c) comply with legal obligations;
(d) maintain accounting or tax records;
(e) prevent or investigate fraud;
(f) maintain system security;
(g) establish, exercise, or defend legal claims;
(h) respond to litigation;
(i) comply with a court order or subpoena;
(j) maintain contractual records;
(k) respond to chargebacks or payment disputes; or
(l) satisfy another applicable legal exception.
Some information maintained or accessed by Prosrver originates from clients, courts, public records, independent process servers, database providers, or other third parties.
Prosrver may not own, control, or have authority to alter or delete the underlying records maintained by those third parties.
Requests concerning original source information may need to be directed to the person or organization that controls that information.
Prosrver may use lawful third-party databases, public records, commercially available data, and research resources for process serving and litigation-support purposes.
Information obtained from these sources may be inaccurate, outdated, incomplete, duplicated, or associated with another person having a similar name.
Prosrver does not guarantee the accuracy or current status of third-party database information.
A request to correct or delete the underlying source information generally must be directed to the provider or public source that maintains that record.
To the extent applicable California privacy law applies to Prosrver or to a particular request, California residents may have rights that include:
(a) requesting information regarding certain personal information collected about them;
(b) requesting access to certain personal information;
(c) requesting correction of inaccurate personal information;
(d) requesting deletion of certain personal information, subject to legal exceptions;
(e) receiving information regarding categories of collection, use, and disclosure;
(f) opting out of qualifying sale or sharing of personal information where applicable;
(g) limiting certain uses or disclosures of qualifying sensitive personal information where applicable; and
(h) receiving nondiscriminatory treatment for exercising applicable privacy rights.
The availability and scope of any particular right depends upon applicable law, statutory thresholds, exemptions, exceptions, and the circumstances surrounding the information.
Nothing in this Privacy Policy constitutes a representation that every California privacy statute applies to Prosrver in every circumstance.
Prosrver may voluntarily respond to privacy inquiries or requests even when a particular statutory privacy requirement does not legally apply to Prosrver or the information involved.
Voluntarily accommodating a request does not constitute an admission that Prosrver is subject to a particular statute or legal obligation.
Prosrver may take reasonable steps to verify the identity and authority of a person submitting a privacy request.
Verification may require information such as:
(a) name;
(b) email address;
(c) telephone number;
(d) job or invoice number;
(e) transaction information;
(f) relationship to the applicable assignment; or
(g) other information reasonably necessary to verify identity and prevent unauthorized disclosure.
Where applicable law permits an authorized agent to submit a privacy request, Prosrver may require reasonable documentation establishing the agent’s authority to act for the person whose information is involved.
Privacy requests from or concerning individuals who were recipients or subjects of legal process may require additional review.
Prosrver may be unable or legally prohibited from providing, deleting, changing, or restricting certain information where doing so would interfere with:
(a) another person’s legal rights;
(b) an active or anticipated legal proceeding;
(c) a client’s legal matter;
(d) evidence relating to service;
(e) litigation or legal privileges;
(f) court requirements;
(g) record-retention obligations;
(h) fraud-prevention interests;
(i) legal claims or defenses; or
(j) another lawful exception.
Prosrver’s website and commercial ordering services are intended for adults and professional users and are not directed to children.
However, legal proceedings and lawful process-serving assignments may contain information concerning minors.
Information concerning minors will be processed only as reasonably necessary for the lawful assignment, legal proceeding, court requirement, legitimate business purpose, or other lawful purpose.
Where an assignment involves a recipient, location, vendor, process server, or service provider outside the United States, information may be transmitted to or processed in another jurisdiction where reasonably necessary to perform the requested assignment and legally permitted.
Privacy and data-protection laws may differ between jurisdictions.
If DisasterFree, LLC or relevant Prosrver operations are involved in a merger, acquisition, financing, reorganization, sale, transfer, or similar business transaction, information may be transferred as part of that transaction subject to applicable law and appropriate protections.
Prosrver may update this Privacy Policy from time to time to reflect changes in law, technology, vendors, security practices, or business operations.
Changes will be posted with an updated effective date or last-updated date.
Unless applicable law requires otherwise, revisions apply prospectively.
Use of Prosrver’s website, online ordering systems, and professional services is also governed by Prosrver’s Terms of Use and Service Agreement.
